There are two avenues an injured worker can take following injury at work.
Firstly, a statutory ‘no fault’ claim which covers medical expenses, lost wages and lump sum compensation, It is a ‘no fault’ based entitlement, meaning that you do not have to prove negligence on the part of your employer to be covered.
Secondly, the Common Law claim allows serious injured workers to pursue their claims through the court process.
The injured worker must be able to prove in court that their employer was negligent with respect to the workplace health and safety which caused the injury. It covers your medical expenses, lost wages, and compensation for pain and suffering.
